Many physicians are familiar with the provisions of Stark Law and the Anti-Kickback Statute, and the requirement that physician contracts (employment, PSA or Co-management) be at a price consistent with “fair market value.” Less is understood about the requirement that contracts also be “commercially reasonable.” This panel will educate attendees about the need to establish and prove commercial reasonableness as part of any physician compensation arrangement and will explore the subject from a legal and third party FMV assessment perspective.
